1. Agreement

By using the Website and/or placing an order, you agree to be bound by these Terms.

2. Changes to these Terms

We may update these Terms from time to time. The version published on the Website at the time you place an order applies to that order. Continued use of the Website after publication of changes means you accept the updated Terms.

3. Account registration

If you create an account, you agree that:

  • the information you provide is accurate and kept up to date;
  • you keep your login details confidential; and
  • you are responsible for activity under your account unless it results from our failure to secure the Website.

We may suspend or close accounts if we reasonably suspect misuse, fraud, or breach of these Terms.

4. Privacy and data protection (GDPR)

We process personal data in accordance with the EU General Data Protection Regulation (GDPR) and our Privacy Policy. We use your data to:

  • process and deliver orders;
  • provide customer support;
  • prevent fraud and improve security; and

8. Orders and contract formation

When you place an order, you make an offer to purchase products.

  • We may accept or reject your order.
  • A contract is formed when we confirm dispatch (or otherwise confirm acceptance by email).
  • If we cannot fulfil an order (e.g., stock issues), we will notify you and refund any payments made for unfulfilled items.

We aim to ensure product information, pricing, and images are accurate. However:

  • packaging and presentation may vary;
  • colours may differ due to screen settings; and
  • occasional errors may occur.

If we discover a material error (e.g., incorrect pricing) before dispatch, we may cancel the order and provide a full refund, or offer you the option to confirm the order at the correct price.

10. Prices, VAT, and payment

  • Prices are shown in the currency selected at checkout and include VAT where applicable, unless stated otherwise.
  • Delivery charges (if any) are displayed at checkout before you place an order.
  • We accept the payment methods shown at checkout.
  • If your payment is not authorised or is reversed, we may cancel the order.

11. Delivery, risk, and title

  • Estimated delivery times shown at checkout are estimates and not guarantees.
  • Risk of loss passes to you when you (or a person you nominate) take physical possession of the goods.
  • Title/ownership passes to you once full payment has been received and the goods have been dispatched (unless mandatory law states otherwise).
  • If you provide an incorrect delivery address or fail to collect a parcel, we may charge additional shipping/handling costs to re-ship, where permitted by law.

12. EU consumer right of withdrawal (14 days)

If you are a consumer in the EU/EEA, you generally have the right to withdraw from a distance contract within 14 days without giving a reason, starting from the day you (or your nominated person) receive the goods.

How to exercise your right of withdrawal

To withdraw, email us at beauty@glowkultur.eu within the 14-day period, stating:

  • your order number,
  • the product(s) you wish to return,
  • your name and contact details.

You must send back the goods without undue delay and no later than 14 days after you notify withdrawal.

Refunds

  • We refund the price paid for the returned goods and, where required by law, the standard outbound delivery cost (if you paid one).
  • We may withhold the refund until we receive the goods back or you provide proof of return.
  • Refunds are made using the same payment method unless agreed otherwise.

Return costs

Unless we state otherwise, you bear the direct cost of returning goods.

Important exceptions (hygiene/health protection)

The right of withdrawal may be excluded for:

  • sealed goods which are not suitable for return for health protection or hygiene reasons once unsealed after delivery (commonly applicable to cosmetics/skincare), and
  • other exclusions under applicable consumer law.

Your Returns Policy should align with what you actually accept.

13. Faulty, damaged, or incorrect goods (legal guarantee)

If goods are faulty, damaged, or not as described, you have rights under EU consumer law. Contact us at beauty@glowkultur.eu and we will work with you to provide an appropriate remedy (repair, replacement, price reduction, or refund, depending on the case and legal requirements).

14. Reviews and user content

If you submit reviews or other content, you grant GlowKultur a non-exclusive, royalty-free licence to use, reproduce, publish, and display that content for Website and marketing purposes. You confirm your content is lawful and does not infringe third-party rights. We may remove content that violates these Terms or applicable guidelines.

15. Promotions and discount codes

Discount codes and promotions are subject to any specific terms stated at the time of issue (e.g., minimum spend, expiry, exclusions, one per order). We may cancel orders where promotions are misused or applied contrary to the promotion rules, where permitted by law.

16. Intellectual property

All content on the Website (including text, images, branding, and design) is protected by intellectual property laws. You may not reproduce or use it for commercial purposes without our prior written permission.

17. Limitation of liability

Nothing in these Terms limits liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, or your statutory consumer rights.

To the maximum extent permitted by law, we are not liable for indirect or consequential damages arising from your use of the Website or products purchased, except where mandatory law provides otherwise.

18. Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions remain in effect.

19. Governing law and jurisdiction (EU-friendly)

These Terms are governed by the laws of Germany, without prejudice to mandatory consumer protections in your country of residence.

If you are an EU consumer, you may also be able to use EU consumer dispute resolution bodies available in your country.
